1. Agreement
These Terms of Use (“Terms”) govern your use of the Kinda Close app for iPhone and Android and the website kindaclose.app (together, the “Service”), provided by Kinda Close, Wölferstrasse 5, 4414 Füllinsdorf, Switzerland (“we”, “us”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you downloaded the App from Apple’s App Store, Apple’s Licensed Application End User License Agreement (Standard EULA) also applies; if you downloaded it from Google Play, the Google Play Terms of Service also apply (see section 8). If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 16 years old to use Kinda Close. By using the Service you confirm that you meet this requirement and are legally able to enter into these Terms.
3. Your account
- When you first open the App, an anonymous account is created for you. You can optionally link Sign in with Apple (iPhone), Google or email to keep your data when you change phones.
- If you do not link a sign-in method, your account is tied to that installation of the App and may be lost if you delete the App or change phones.
- You are responsible for keeping your device and sign-in credentials secure and for activity that happens under your account. Tell us promptly at hello@kindaclose.app if you believe your account has been compromised.
- Please give accurate information and keep it up to date. One account per person.
4. Connecting with your partner
- Kinda Close is made for two: you connect with one partner using a 6-character invite code. Only share your code with the person you want to connect with.
- Connect only with someone who wants to be connected with you. Either partner can disconnect at any time; disconnecting unlinks both accounts.
- Content you share in the App is visible to your connected partner. Think before you share — once your partner has seen something, we cannot make them unsee it.
5. Acceptable use
Kinda Close is a space for kindness. You agree not to:
- harass, threaten, stalk, intimidate, coerce or abuse anyone, including your partner;
- use the Service to monitor or control another person without their consent;
- upload or send content that is illegal, including content that sexually exploits minors, depicts non-consensual intimate imagery, infringes someone else’s rights, or incites violence or hatred;
- share another person’s private information or images without their permission;
- impersonate anyone, or create accounts by automated means;
- interfere with, probe, overload, reverse engineer or attempt to gain unauthorised access to the Service, other accounts or our systems, except as permitted by mandatory law;
- use the Service for commercial purposes, spam or advertising.
Please respect your partner: shared spaces work best when both people feel safe. If someone is misusing Kinda Close to hurt you, contact us at hello@kindaclose.app. If you are in danger, contact your local emergency services.
6. Your content
- You keep all rights to the answers, photos, letters and other content you create (“Your Content”).
- You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display Your Content only as necessary to operate and provide the Service to you and your connected partner — for example to store your photos and show them to your partner. This licence ends when Your Content is deleted, subject to the backup periods described in our Privacy Policy.
- We do not use Your Content for advertising and do not sell it.
- You are responsible for Your Content and confirm that you have the right to share it.
- We may remove content or restrict accounts where we become aware of a violation of these Terms or of the law.
7. Premium subscriptions
Kinda Close Premium is available as an auto-renewing subscription for $4.99 per month or $29.99 per year (US prices; the price in your currency is shown in the store before you buy), with a 7-day free trial for eligible new subscribers. Premium unlocks all question packs (Deep, Future and Spicy), additional widget styles and an unlimited Moments album.
7.1 Billing through Apple or Google
- On iPhone, purchases are made through Apple In-App Purchase and charged to your Apple ID. On Android, purchases are made through Google Play Billing and charged to your Google Play account. We never see your payment details.
- Auto-renewal: your subscription renews automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- Free trial: if you start a free trial, it converts automatically into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial is forfeited when you purchase a subscription, where applicable.
- Manage or cancel: on iPhone, in Settings → [your name] → Subscriptions (Apple ID settings) or at apps.apple.com/account/subscriptions. On Android, in the Google Play Store → Payments & subscriptions → Subscriptions or at play.google.com/store/account/subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the paid period.
- Deleting the App or your account does not cancel your subscription. Please cancel it in the store as described above.
- Refunds: are handled by Apple or Google according to their policies — request one at reportaproblem.apple.com (Apple) or via Google Play’s refund process (Google). We cannot issue refunds for store purchases ourselves. This does not limit any rights you have under mandatory consumer law.
- Price changes: if the price changes, you will be informed in advance by Apple or Google according to their rules, and, where required, asked to agree.
- Restore purchases: if you reinstall the App or change phones on the same platform, you can restore your subscription in the App.
7.2 One subscription for both partners
- When one partner holds an active Premium subscription, the connected partner also receives Premium features while the two accounts are connected — also if the partners use different platforms (iPhone and Android).
- The subscription belongs to and is billed to the partner who bought it. If you disconnect, the partner who did not buy it loses access to Premium features. Disconnecting does not cancel or refund the subscription.
- A subscription can be shared with one connected partner at a time.
8. App Store and Google Play
8.1 If you got the App from Apple’s App Store
Apple’s Standard EULA applies to your use of the App in addition to these Terms. These Terms are between you and us only, not with Apple, and:
- we, not Apple, are solely responsible for the App and its content;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or privacy claims;
- in the event of a third-party claim that the App infringes intellectual property rights, we, not Apple, are responsible for its investigation, defence, settlement and discharge;
- you confirm that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce them against you as a third-party beneficiary.
8.2 If you got the App from Google Play
The Google Play Terms of Service apply to your download and to purchases made through Google Play. Google is not a party to these Terms and is not responsible for the App.
9. Our rights
The Service — including the App, its design, the questions and prompts, illustrations, the Kinda Close name and logo — is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your personal, non-commercial use, in line with these Terms and the applicable store rules.
10. Availability and changes
We work hard to keep Kinda Close running smoothly, but the Service is provided “as is” and “as available”. We do not guarantee that it will always be available, uninterrupted or error-free, or that content will never be lost. We may change, add or remove features, and may suspend the Service for maintenance. If we discontinue the Service as a whole, we will give reasonable notice where possible.
11. Liability
To the extent permitted by Swiss law, we exclude liability for damages arising from the use of, or inability to use, the Service, in particular for slight negligence, indirect or consequential damages, lost data and lost profits. Liability for damages caused intentionally or through gross negligence, for personal injury, and any other liability that cannot be excluded or limited under mandatory law remains unaffected. Nothing in these Terms limits rights you have as a consumer under mandatory law in your country of residence.
12. Termination
- You can stop using the Service and delete your account at any time in Settings → Account → Delete account or by emailing us.
- We may suspend or terminate your account if you seriously or repeatedly breach these Terms, if required by law, or to protect other users or the Service. Where reasonable, we will tell you why and give you a chance to respond.
- Remember to cancel any subscription in the App Store or Google Play — termination of your account does not cancel it automatically.
- Sections that by their nature should survive termination (for example liability and governing law) remain in effect.
13. Changes to these terms
We may update these Terms, for example when we add features or when the law changes. We will publish the new version here and, for material changes, inform you in the App in advance. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, you can delete your account at any time.
14. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is the seat of the operator in Switzerland, unless mandatory law provides otherwise. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence and may bring proceedings in the courts there where that law allows it.
If any provision of these Terms is found to be invalid, the remaining provisions remain in effect.
